Terms of Service

These terms are the agreement between you and New Life Host. They are written to be read, so please read them before you order.
1. Who we are
New Life Host ("New Life Host", "we", "us") is a sole proprietorship based in Texas, United States. Where these terms say "you", they mean the person or organisation that creates an account or orders a service.
By creating an account, placing an order or using any of our services (the website, the client area, the game panel and the game servers we host), you agree to these terms, our Privacy Policy, our Refund Policy and our Acceptable Use Policy. If you do not agree, do not use the services.
2. Who can use New Life Host
- You must be at least 13 years old to create an account.
- If you are under 18, a parent or legal guardian must read and agree to these terms for you, and they are responsible for your payments and your use of the services.
- You must give accurate account details and keep them up to date.
- You are responsible for keeping your password safe and for everything that happens under your account, including anything done by people you give access to your server (for example, panel subusers).
3. What we provide
We provide hosted Minecraft servers with the resources (memory, CPU, storage and network port) described on the plan you buy at the time you buy it, plus access to our custom game panel.
- We may move your server to different hardware, a different provider or a different location, as long as your plan's resources stay the same or better.
- Minecraft, server software (such as Paper, Purpur, Fabric, Forge and NeoForge), plugins, mods and modpacks are made by other people. Panel tools that install them, such as the Plugins, Mods, Modpacks and Software tabs, download them from their publishers (such as Modrinth) for you. We do not own, check or guarantee third-party software, and its own licence applies.
- We aim to have new servers ready within 24 hours of payment. If we cannot deliver your server within 7 days of payment, you can have a full refund (see the Refund Policy).
- We work hard to keep servers online, but we do not promise any particular uptime. Servers may be briefly unavailable for maintenance, updates or problems outside our control.
4. Billing, renewal and cancellation
- Prices are in US dollars and are charged in advance for each billing period (normally monthly).
- Your service renews automatically at the end of each billing period, at the then-current price, until you cancel.
- We send an invoice 7 days before each renewal and a reminder 3 days before it is due.
- You can cancel at any time from the client area. Cancelling stops all future charges. Your server keeps running until the end of the period you have already paid for.
- If we change the price of your plan, we will tell you by email at least 14 days before the new price applies to you. You can cancel before then.
- Sales tax is added where the law requires it.
- If a renewal is not paid, we suspend the server 2 days after the due date, and delete the server and all of its files 14 days after the due date. Deleted servers cannot be recovered.
- Unpaid new orders are cancelled after 7 days.
5. Refunds and chargebacks
All payments are final except as described in our Refund Policy. If you have a problem with a charge, please contact us before disputing it with your bank or payment provider; most problems are fixed quickly. If you open a chargeback, we may suspend your services and account while it is resolved.
6. Your content and your server
- You keep ownership of everything you upload or create on your server (worlds, configs, plugins, files and so on).
- You give us permission to store, copy, back up, transfer and process your content only as needed to run the services for you.
- You are responsible for having the rights to everything you put on your server, and for how you run it, including your own players and community.
- You must follow the Minecraft End User License Agreement and Mojang's usage guidelines, including their rules on charging players and selling in-game items.
- Keep your own backups. The panel's backup tools are provided as a convenience. We are not responsible for lost or corrupted data, whatever the cause.
7. Acceptable use
You must follow our Acceptable Use Policy. We may suspend or end a service that breaks it, or that puts our systems, other customers or the public at risk, without notice when we need to act quickly. Services ended for breaking these terms are not refunded.
8. Suspension and termination
We may suspend or end your services or account if you break these terms, if payment fails, if the law or a valid legal request requires it, or if your server is attracting attacks that threaten other customers. Where it is reasonable, we will tell you first and give you a chance to fix the problem. You may stop using the services and close your account at any time.
9. Disclaimers
The services are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise the services will be uninterrupted, secure or error-free.
10. Limits on our liability
To the fullest extent the law allows:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; and
- our total liability for any claim about the services is limited to the amount you paid us for the affected service in the 3 months before the claim arose.
Some places do not allow some of these limits, so they may not all apply to you. Nothing in these terms limits liability that cannot be limited by law.
11. Your responsibility to us
You agree to cover our reasonable losses and costs (including reasonable legal fees) arising from a third party's claim about your content, your server or your breach of these terms.
12. Disputes and governing law
- These terms are governed by the laws of the State of Texas and applicable US federal law, without regard to conflict-of-law rules.
- Before starting any legal claim, please email us and give us 30 days to try to resolve it informally.
- Any legal action must be brought in the state or federal courts located in Texas, and both of us agree to those courts' jurisdiction. Either of us may instead bring an eligible claim in small claims (justice) court.
13. Changes to these terms
We may update these terms. If a change is significant, we will tell you by email or in the client area before it takes effect. If you keep using the services after a change takes effect, you accept the updated terms.
14. Not affiliated with Mojang or Microsoft
New Life Host is not an official Minecraft product and is not approved by or associated with Mojang or Microsoft. "Minecraft" is a trademark of Mojang Synergies AB.
15. Everything else
- These terms and the policies they link to are the whole agreement between us about the services.
- If part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your account or these terms to someone else without our written permission. We may transfer them to whoever takes over the business.
